These Terms of Service (“Terms”) govern access to and use of the website marketcircles.es (the “Site”) and any services described on it, operated by Market Circles SL (“Market Circles”, “we”, “us”). By using the Site or engaging our services, you agree to these Terms.

1. About Market Circles SL

Market Circles SL is a company registered in Spain (NIF/CIF B02911683), with registered address at Avda. Jerez, Torrenueva, Núm. 2, Pueblo Andaluz, 29649 Mijas (Málaga), Spain. See also our Legal Notice for full Commercial Registry details.

2. Our services

Market Circles provides marketing operations services, which may include automation design and implementation, campaign management, social channel management, predictive dialler / outbound calling infrastructure, and data cleansing and enrichment. The specific scope, deliverables, timelines and fees for any engagement are agreed separately in a written proposal, order form or contract, which takes precedence over these Terms in the event of a conflict.

3. Use of the Site

You agree to use the Site only for lawful purposes and not to misuse it, attempt to gain unauthorised access to it, or interfere with its normal operation. Content on the Site is provided for general information and does not constitute a binding offer unless expressly stated in a signed agreement.

4. Intellectual property

All content on the Site, including text, graphics, logos and the Market Circles brand, is owned by or licensed to Market Circles SL and may not be reproduced or used without prior written consent, except as permitted for normal browsing of the Site.

5. Client obligations

Where you engage us for services, you agree to provide accurate information, timely access to relevant systems and data, and any approvals reasonably required for us to perform the work. You remain responsible for ensuring you have the necessary rights and consents for any data you provide to us, including contact lists used for campaigns or outbound dialling.

6. Fees and payment

Fees for services are set out in the relevant proposal or contract. Unless otherwise agreed in writing, invoices are payable within the terms stated on the invoice.

7. Limitation of liability

To the maximum extent permitted by law, Market Circles SL shall not be liable for indirect, incidental or consequential losses arising from use of the Site or our services. Nothing in these Terms limits liability that cannot be limited under applicable Spanish or EU law.

8. Termination

Either party may terminate an active engagement in accordance with the terms set out in the applicable contract or proposal. We may suspend or restrict access to the Site at our discretion where we reasonably believe these Terms have been breached.

9. Governing law

These Terms are governed by the laws of Spain. Any dispute arising from these Terms or use of the Site shall be subject to the jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection rules that may apply.

10. Changes to these Terms

We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
